Contrary to what happened with Hayden Panettiere’s dad, “Transformers” star Shia LaBeouf will not be charged with drunken driving, following his car accident last July.

Announced Thursday by the Los Angeles County District Attorney’s Office, according to their spokeswoman Jane Robison, “After reviewing the case, we’ve declined to file any charges due to insufficient evidence”. She also said that prosecutors are mulling charges against two other people involved in the crash, but could not provide further details. Robison later added that prosecutors instead plan to file criminal charges against the other driver, who was found to have run a red light.

The actor, who played as the son of Indiana Jones on the latest installment of the movie, was arrested July 27 after an early morning crash occurred in West Hollywood that badly injured his hand and sent him to a hospital for several days. He was cited with misdemeanor DUI while he was still at the hospital, but sheriff’s deputies said later that LaBeouf was not at fault in the accident. In fact, it was the other driver who ran over Shia’s truck.

LaBeouf’s attorney Michael Norris said about the news, “We’re very happy with the prosecutor’s decision, and we’re glad this whole thing resolved without Shia having to go to court”. But the 22-year-old should hold his eagerness to jumping joy, because according to Steve Whitmore, a spokesman for Los Angeles Sheriff’s Department, LaBeouf still faces a DMV hearing Friday and the possible suspension of his driver’s license as the effect of his refusal to take a breathalyzer test.

Whitmore said, “When an individual refuses to take a blood alcohol test, that person’s license is automatically suspended for six to nine months”. About the hearing that was scheduled for Friday, Norris doubted the hearing will take place then, and doesn’t think the actor will lose his license. As he said, “I anticipate that once we do have the opportunity to litigate the matter at the DMV that his license will not be suspended”.

LaBeouf was last seen in public at the Sept. 16 premiere of his new movie “Eagle Eye”, his hand was in a white protective guard and he kept it in his pocket most of the night. The actor talked about his future plan and his condition in an interview, “I’m just propped up right now to do Transformers 2. Then, when I get another surgery, I’ll start recovering. Right now, I’m getting through.”

We’re happy for you on the good news Shia, and hoping the best for your recovery. God Bless!
