Kelly Rutherford and Estranged Husband Had Reached Temporary Custody Settlement

Kelly Rutherford can breathe more relieve now. Temporarily, though.

The Gossip Girl star and her estranged husband, German businessman Daniel Giersch, had reached a temporary settlement of joint legal and physical custody over their children; 2-year-old Hermes and 2-month-old Helena.

Inside the court papers that was filed in Santa Monica, California, the agreement is in effect until April 2010 and built around Rutherford’s filming demands in New York, where both parents will temporarily live. The former couple were also ordered into co-parenting counseling. Rutherford’s attorney Stefanie Hall said that “Ms. Rutherford is pleased with the results which allow her to temporarily reside in New York with both children so she can fulfill her work commitments.”

40-year-old Rutherford married her second husband, Giersch in August 2006. Their marriage seems fine, until she filed for divorce from her 36-year-old husband early this year, when she was two months pregnant with Helena. Irreconcilable differences was cited as the reason of the split. Well, hopefully the agreement could run smoothly between the two.
